Terms and Conditions

Before signing up to become an INOURFUTURE “Futurist”(member of inourfuture.com) please read the terms and conditions below. By using or visiting inourfuture.com (the “Site”) you agree to INOURFUTURE’S Terms & Conditions and Privacy Policy. If you do not agree to any of these terms pleas edo not use inourfuture.com.

We recommend that from time-to-time you review the most up-to-date version of these Terms and Conditions on the Site and by accepting this agreement you also agree to be bound by any modifications or revisions.

1. Privacy Policy

Your privacy is important to us, please read our Privacy Policy which outlines how we collect and use the information you post on the Site.

2. Passwords

When you sign up to become a Futurist, you are responsible for keeping your password confidential. You agree not to use the account, username, or password of another Futurist at any time nor to disclose your password to any third party.  Please notify INOURFUTURE immediately if you suspect any unauthorised use of your account or access to your password.

3. Sharing Your Content and Information

3.1  "Content" includes text, software, scripts, graphics, photos, logos, trademarks, sounds, music, videos, interactive features and the like. Before you upload Content to INOURFUTURE please ensure:

i)  you are the sole owner of all the Content or have the right to grant a licence of the Content;

ii) posting the Content does not violate any applicable laws or rights, including but not limited to data protection laws, copyright, privacy rights, publicity rights, intellectual property rights,  contract rights or any other rights of any person or entity, and you agree to pay (and indemnify us for) all royalties, fees and any other monies owing to any persons or entity which you or we may become liable to pay by reason of any Content posted to the Site; and

iii) you have obtained the prior consent of any individuals whose personal information or image you use and/or disclose on or through INOURFUTURE.


4.  ContentPropriety Rights

4.1  INOURFUTURE does not claim any ownership rights in Content posted to the Site and you retain the rights to your Content after posting it.  By posting Content to the Site, you grant INOURFUTURE a worldwide, royalty-free licence to use, modify, delete from, add to, publicly display, reproduce, and distribute such Content solely on or through the Site, including without limitation distributing part or all of the Site in any media formats and through any media channels.  This licence does not grant INOURFUTURE the right to sell or otherwise distribute your Content outside of the Site.  After you remove your Content from the Site we will cease distribution as soon as practicable, (removed content may temporarily persist in backup copies) and at such time, the licence will terminate.

4.2  The Site contains Content of other Users and you may not download, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, display, sell, license or otherwise exploit any such Content appearing on the Site.

5. Protecting Copyrights and Other Intellectual Property

5.1  INOURFUTURE respects the intellectual property rights of others, and requires our Futurists do the same. You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. INOURFUTURE has the right to terminate the membership of infringers.

5.2  If you believe your work has been copied and posted on or through the Site in a way that constitutes copyright infringement, please contact INOURFUTURE through the CONTACT link at the bottom of the website and click here to see our copyright complaints procedure.

6. Monitoring Content

6.1  INOURFUTURE may reject, refuse to post or delete any Content for any or no reason, including Content that in the sole judgment of INOURFUTURE violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. INOURFUTURE assumes no responsibility for monitoring the Site for inappropriate Content or conduct and assumes no responsibility for the Content itself, the removal of inappropriate Content or for the conduct of the User submitting any such Content.

6.2  You are solely responsible for the Content that you post on the Site, any material or information that you transmit to other Futurists and for your interactions with other Users.

7. Policy and process for barring users who have uploaded infringing material

7.1  Please choose carefully the information you post on or through the Site and that you provide to other Users. Your INOURFUTURE upload must not include any form of Content that does not comply with Clause 3.1.  If you become aware of misuse of Content on the Site by any person, please click on the CONTACT link at the bottom of the Site.

7.2  INOURFUTURE reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to deny, restrict, suspend, or terminate your access to all or any part of the Site at any time, for any or no reason, with or without prior notice or explanation, and without liability.

8. Member Disputes

You are solely responsible for your interactions with other Futurists. INOURFUTURE reserves the right, but has no obligation, to become involved in any way with disputes between you and other Futurists (other than as set out in Clause 5.2).

9. Term

This Agreement, and any posted revision to this Agreement, shall remain in full force and effect while you use INOURFUTURE or are a Futurist. You may terminateyour membership at any time, for any reason, by using the appropriate features on the site. INOURFUTURE may terminate your membership at any time, for any or no reason, with or without prior notice or explanation and without liability. Even after membership is terminated, this Agreement will remain in effect.

10. Disclaimers

- INOURFUTURE is not responsible for the Content uploaded on the Site and the Content does not reflect the opinions or policies of INOURFUTURE.

- INOURFUTURE is not responsible for the conduct, whether online or offline, of any User of INOURFUTURE.

- Profiles and entries created and posted by Futurists on the INOURFUTURE Website may contain links to other websites, INOURFUTURE is not responsible for the content, opinions expressed, accuracy or completeness of third party websites and INOURFUTURE does not imply approval or endorse any such sites. Access to these third-party sites is at your own risk.

- INOURFUTURE cannot guarantee and does not promise any specific results fromuse of the Site.

Limitation on Liability

IN NO EVENT SHALL INOURFUTURE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS OR DAMAGE, (INCLUDING INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOST PROFIT DAMAGES) ARISING FROM YOUR USE OF THE INOURFUTURE WEBSITE, EVEN IF INOURFUTURE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Other

This Agreement is accepted upon your use of the INOURFUTURE Website whether or not you become a Futurist. This Agreement constitutes the entire agreement between you and INOURFUTURE regarding the use of the Site. The failure of INOURFUTURE to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. This Agreement is governed by the laws of Victoria, Australia and you submit to the jurisdiction to Courts of Victoria and Australia.
